Overview
Divorce is a difficult situation for all involved. When a privately-held business is the primary marital asset, the problem is magnified. Sustainable income needs to be determined for alimony and child support purposes. Business value needs to be determined for equitable distribution. Hidden assets need to be uncovered and valued. All of this needs to be done with minimal disruption to the business’ operations and financial stability.
Successfully managing these situations requires more than just legal guidance—it demands deep financial insight, sensitivity to personal circumstances, objective analysis, and a clear understanding of every asset involved. Anchin’s Forensic, Litigation and Valuation Services professionals provide the specialized expertise needed to uncover, analyze, and accurately value assets, giving clients a comprehensive view of their financial position and enabling them to make confident, informed decisions.

Representative Engagements
- Accurately valued a construction equipment leasing company at a significant premium to book value despite three years of operating losses, by estimating future sales, which resulted in an equitable distribution for the client. As part of the engagement, we conclusively demonstrated that the opposing expert’s report possessed errors that proved it was not credible.
- Valued an $8 million-dollar, multi-office medical practice for alimony and equitable distribution in divorce, including an analysis of future office expansions, medical procedures performed, Current Procedural Terminology (“CPT”) code reimbursements and prospective CPT code changes.
- Provided a rebuttal report critiquing an opposing expert’s use of the “excess earnings method,” which claimed significant goodwill to a distribution business. Anchin provided an accurate estimation of reasonable compensation and estimates of the business’s fair market value under the “net asset method” of the cost approach, the “M&A transactions method” of the market approach, and the “capitalization of income method” of the income approach, all of which indicated the business had no goodwill above its asset value.
- Performed a detailed forensic analysis of multiple business entities’ books and records to determine whether certain costs were personal expenditures and not incurred for business purposes, and/or unusual in nature, and whether these expenditures required adjustment for business valuation purposes.
