White Collar Crime Case Study: Uncovering Labor Reporting Discrepancies on Public Construction Projects

Client: New York State Attorney General

Focus Area: Labor Compliance | Forensic Review | Government Contracting

Overview:

Our team was engaged by the New York State Attorney General’s Office to evaluate compliance with workforce reporting requirements on a major construction project. The investigation centered on identifying potential discrepancies in labor reporting and subcontractor allocations.

Our Approach:

  • Reviewed over 2,600 Monthly Employment Utilization Reports (DDP-3s) submitted by contractors.
  • Analyzed more than 1,300 certified payrolls for accuracy, consistency, and proper documentation.
  • Assessed subcontractor credit allocations and verification procedures for compliance with program rules.

Key Findings:

  • Identified widespread underreporting of workforce hours by multiple parties.
  • Detected unsupported subcontractor credit allocations stemming from weak documentation and oversight.
  • Exposed systemic verification failures that allowed inaccurate reporting to persist.

Outcome:

The investigation led to a civil settlement in which the client paid $500,000 in restitution. The findings underscored the importance of rigorous documentation and transparent labor reporting practices on public contracts.
